ELIGIBILITY: The Netspend Earned Wage Access The Summer Fun Sweepstakes 3 (the or this “Sweepstakes”) is open to legal residents of the fifty United States and the District of Columbia, who are (a) at least 18 years of age (or 19 years of age in AL and NE, or 21 years of age in MS) or older, (b) current employees in good standing on the payroll of the Employer (as defined herein) whom the Employer has deemed eligible for the Netspend Earned Wage Access (“NEWA”) program, and (c) who are NEWA users as of the time of entry with an active NEWA Mobile App account, in relation to their employment with the Employer ((a)-(c), together, the “Eligibility Requirements”). Participation by all entrants is conditioned upon acceptance of the Netspend Earned Wage Access Terms of Service, incorporated herein by reference and available on the NEWA Mobile App (the “Mobile App”), and these Official Rules (the “Official Rules”). Employees, directors and officers of Sponsor or Administrator, and each of their respective parents, subsidiaries and affiliated companies, and Sponsor's and/or Administrator’s advertising and sweepstakes agencies and each of their respective officers and directors (collectively, with Sponsor and the Administrator, the "Sweepstakes Entities"), and each of their immediate family members and/or those living in the same household of each (whether legally related or not), are ineligible to participate in the Sweepstakes. For purposes of this Sweepstakes, "immediate family members" are defined as spouse, domestic partner, parents, legal guardians, in-laws, grandparents, siblings, children and grandchildren.

AGREEMENT TO THE OFFICIAL RULES: Each individual that participates in this Sweepstakes and submits an Entry (each, an “Entrant”) agrees to abide by the Official Rules and by the decisions of Sponsor or its designees, which are final and binding on all matters pertaining to this Sweepstakes. Under the Official Rules, each Entrant is referred to as the “Entrant”.
4. SWEEPSTAKES PERIOD: This Sweepstakes begins on Sunday, June 15, 2025, at 12:01 a.m. Central Time and ends on Sunday, June 29, 2025, at 11:59 p.m. Central Time (the “Sweepstakes Period”). Entries received before or after the Sweepstakes Period are void. Administrator’s computer is the official time-keeping device for the Sweepstakes.
5. ENTRY; HOW TO ENTER: To complete an entry, you must meet all of the Eligibility Requirements. You may contact Sponsor at ewasupport@netspend.com to determine whether your NEWA Mobile App account is active and for more information on how to download and use the Mobile App.
If you complete at least two (2) NEWA transfers on the Mobile App that are compliant with the NEWA Terms of Service (including that all NEWA transfers must be for an amount of $10 or greater) (indicated as “Cash Outs” on the Mobile App and “Earned Wage Payments” in the Terms of Service) during the Sweepstakes Period, you will receive one (1) entry (each, an “Entry”) into this Sweepstakes, regardless of the transfer amount or whether the transfer is a free or fee-based transfer. You may only receive one (1) Entry for this Sweepstakes, even if you conduct more than two (2) NEWA transfers during the Sweepstakes Period. The number of NEWA transfers you may conduct may be limited by the Netspend Earned Wage Access Terms of Service and limitations determined by the employer that gave you access to the Netspend Earned Wage Access service. If you do not wish to participate in the Sweepstakes and would like to remove your name from the pool of eligible entrants, you may contact Sponsor at ewasupport@netspend.com at any time, up until the end of the Sweepstakes Period. Sponsor reserves the right to qualify Entries and to reject any Entries that do not meet the requirements for participation as established by Sponsor.
Normal Internet access, phone, and usage charges imposed by your online or phone service may apply. If you are entering via a mobile device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply. Automated and/or third-party entries are prohibited and will be disqualified. Multiple Entrants are not permitted to share the same email address or NEWA Mobile App account. Any attempt by any Entrant to obtain more than the permitted number of entries by using multiple and/or different identities, forms, registrations, addresses or any other method will void all of that Entrant’s entries, and that Entrant may be disqualified at Sponsor’s and/or Administrator’s discretion. Incomplete, illegible, corrupted or untimely entries are void and will be disqualified. Sponsor and its agencies are not responsible for lost, late, incomplete, damaged, stolen, misdirected or illegible entries; lost, interrupted or unavailable network, server or other connections; or miscommunications, computer or software malfunctions, telephone transmission problems, technical failures, garbled transmissions, damage to a user’s computer equipment (software or hardware) or other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise. Proof of sending or submission will not be deemed to be proof of receipt of entry by Sponsor and/or Administrator. In the event of a dispute as to the identity of an Entrant, the authorized holder of the NEWA Mobile App account used to enter will be deemed to be the Entrant or participant, as determined by Sponsor. Potential winner may be required to show proof of being the authorized NEWA Mobile App account holder.
Sponsor assumes no responsibility for computer system, hardware, software, application, or program malfunctions or other errors, failures, delayed computer transactions, telecommunications or network connections that are human or technical in nature (whether caused by Sponsor, the Administrator, the users, or by any of the equipment or programming associated with or utilized in this Sweepstakes) or for any technical or human error that may delay or prevent an Entrant’s ability to participate in this Sweepstakes. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Sweepstakes and award the prizes from the Entries submitted up to the time of termination or suspension should causes beyond Sponsor’s control, including unauthorized human intervention, which, in the sole opinion of Sponsor, corrupt, compromise or materially affect the administration, fairness, security or proper play of this Sweepstakes or proper submission of Entries. Sponsor is not liable for any loss, injury or damage caused, whether directly or indirectly, in whole or in part, from downloading data or otherwise participating in this Sweepstakes.
CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR MOBILE APPLICATION OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE; SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

SELECTION OF WINNERS: Eight (8) winners will be selected by a random drawing from all eligible Entries received during the Sweepstakes Period within three (3) business days after the end of the Sweepstakes Period (each, a “Winner”). Odds of winning depend upon the number of eligible Entries received.
7. WINNER NOTIFICATION: Each potential winner will be notified by either the email address or phone number associated with the potential winner’s NEWA Mobile App account within seven (7) business days following the date such potential winner is selected. If the potential winner does not acknowledge acceptance of the Prize and return all required documentation, including a declaration of eligibility and liability and publicity release and agreement to these Official Rules, wherever lawful, within ten (10) business days after being notified that they have been selected as a potential winner, then such potential winner shall forfeit the Prize and an alternate potential winner will be selected in the potential winner’s place by a random drawing of remaining Entrants and will be subject to the same notification and confirmation requirements set forth in this subsection.
8. PRIZE: Eight (8) prize Winners will each win one (1) prize. Each prize consists of one (1) $100 smartOne Visa Prepaid Card (the “Prize”). Total approximate retail value of all eight prizes: $800. Limit one (1) Prize per Winner. The Prize is non-transferable and non-refundable, and no substitutions will be made except as provided herein, in Sponsor’s sole discretion. Sponsor reserves the right to substitute a particular Prize with another of comparable or greater value than that Prize. Sponsor will not replace any lost, mutilated, or stolen Prizes. Only the number of prizes stated in these Official Rules is available to be won in the Sweepstakes. If, by reason of a print or other error, more prizes are claimed than the number set forth in these Official Rules, prize winner(s) will be selected in accordance with the winner selection method described above from among all eligible claimants making purportedly valid claims to award the advertised number of prizes available. Sponsor is not responsible for any delay or cancellation of the prize delivery due to unforeseen circumstances or those outside of their control. 10. PRIVACY: By submitting an Entry, Entrants acknowledge and agree that any personal information that they provided may be maintained, used and disclosed in accordance with Sponsor’s privacy policy, which can be found at https://www.rainapp.com/netspend/privacy-notice.
11. RELEASE AND PUBLICITY: Any Winner, as a condition of receiving any Prize, irrevocably grants the Sponsor and each of its designees, licensees, successors, assigns and sub-licensees the right and permission to use such Winner’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising, promotional and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation, unless prohibited by law.
Each Entrant agrees that the Sweepstakes Entities (A) shall not be responsible or liable for, and are hereby released, discharged and held harmless from, any and all claims, liability, costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, arising out of or related, directly or indirectly, to participation in this Sweepstakes or any Sweepstakes-related activity, or from an Entrant’s acceptance, receipt, possession and/or use or misuse of any Prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any Prize, including, without limitation, to any Prize’s quality or fitness for a particular purpose. Sponsor assumes no responsibility for any damage to an Entrant’s or any other person’s computer system or wireless phone which is occasioned by accessing the Netspend Earned Wage Access Mobile App or otherwise participating in this Sweepstakes, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due submissions or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Each Entrant further agrees to indemnify and hold harmless Sweepstakes Entities from and against any and all liability resulting or arising from this Sweepstakes and to release all rights to bring any claim, action or proceeding against Sweepstakes Entities. Sponsor is not responsible for the actions of Entrants in connection with this Sweepstakes, including any Entrant’s attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of this Sweepstakes. Each Entrant further understands and agrees that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. Each Entrant acknowledges that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH, IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.” The releases hereunder are intended to apply to all claims not known or suspected to exist. The intent of the releases hereunder is to waive the effect of any laws which require an intent to release future unknown claims.
12. TAMPERING WITH SWEEPSTAKES: Sweepstakes Entities are not responsible for violations of the Official Rules that impact any individual’s privacy rights in connection with this Sweepstakes, including any Entrant’s attempt(s) to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of this Sweepstakes. Sponsor reserves the right in its sole discretion to disqualify any Entrant who is found to be tampering with the entry process or the operation of this Sweepstakes or the Netspend Earned Wage Access App to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of this Sweepstakes, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No illegible, incomplete, forged, or automated multiple entries will be accepted. Sponsor reserves the right to modify, extend, suspend, or terminate this Sweepstakes if it determines, in its sole discretion, that this Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of this Sweepstakes as contemplated herein.
13. SUSPENSION / MODIFICATION / TERMINATION: In the event Sponsor is prevented from awarding any Prize or continuing with this Sweepstakes as contemplated herein by any event beyond its control, Sponsor shall have the right to modify, suspend, extend or terminate this Sweepstakes. If this Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select a Winner of any remaining Prize(s) in a random drawing from all eligible, non-suspect registered Entrants as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each Entrant’s sole and exclusive remedy under such circumstances.
14. GENERAL: The invalidity or unenforceability of any provision of the Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules or documents related to receipt of the Prize is determined to be invalid or otherwise unenforceable or illegal, the Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of the Official Rules will not constitute a waiver of that provision. When terms such as “may” are used in the Official Rules, Sponsor has sole and absolute discretion. Entrants agree to waive any rights to claim ambiguity of the Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event that there is a discrepancy between statements contained in the Official Rules, any Sweepstakes-related materials, privacy policy or terms of use on the Netspend Earned Wage Access App, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion.
Sweepstakes participation constitutes Entrant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. In the event there is a discrepancy or inconsistency between disclosures or other statements (in any and/or all media) contained in any Sweepstakes materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control.
Sponsor and its agents are not responsible for (1) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to, malfunctions, interruptions or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error that may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor. If, for any reason, the Sweepstakes cannot be run as planned, Sponsor may disqualify any suspect entries and (a) suspend the Sweepstakes and modify the Sweepstakes to address the impairment, then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; and/or (b) terminate the Sweepstakes and award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment.

GOVERNING LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules or the rights and obligations of Entrants or Sponsor in connection with this Sweepstakes shall be governed by and construed in accordance with the internal laws of the state of Georgia without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws.
BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANTS AGREE THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. 16. DISPUTE RESOLUTION, WITH NO CLASS RELIEF: THE PARTIES EACH AGREE TO FINALLY SETTLE ALL DISPUTES ONLY THROUGH ARBITRATION, ON AN INDIVIDUAL BASIS, WITH NO CLASS RELIEF; PROVIDED, HOWEVER, THAT SPONSOR SHALL BE ENTITLED TO SEEK INJUNCTIVE OR EQUITABLE RELIEF IN THE STATE AND FEDERAL COURTS IN FULTON COUNTY, GEORGIA, AND ANY OTHER COURT WITH JURISDICTION OVER THE PARTIES. IN ARBITRATION, THERE IS NO JUDGE OR JURY AND REVIEW IS LIMITED. THE ARBITRATOR’S DECISION AND AWARD IS FINAL AND BINDING, WITH LIMITED EXCEPTIONS, AND JUDGMENT ON THE AWARD MAY BE ENTERED IN ANY COURT WITH JURISDICTION. THE PARTIES AGREE THAT, EXCEPT AS SET FORTH ABOVE, ANY CLAIM, SUIT, ACTION OR PROCEEDING ARISING OUT OF OR RELATING TO THIS SWEEPSTAKES SHALL BE RESOLVED SOLELY BY BINDING ARBITRATION BEFORE A SOLE ARBITRATOR UNDER THE STREAMLINED ARBITRATION RULES PROCEDURES OF JAMS INC. (“JAMS”) AVAILABLE AT https://www.jamsadr.com/adr-rules-procedures/ OR ANY SUCCESSOR TO JAMS. IN THE EVENT JAMS IS UNWILLING OR UNABLE TO SET A HEARING DATE WITHIN FOURTEEN (14) DAYS OF THE FILING OF A “DEMAND FOR ARBITRATION”, THEN EITHER PARTY CAN ELECT TO HAVE THE ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (“AAA”) OR ANY OTHER MUTUALLY AGREEABLE ARBITRATION ADMINISTRATION SERVICE. IF AN IN-PERSON HEARING IS REQUIRED, THEN IT WILL TAKE PLACE IN ATLANTA, GEORGIA; PROVIDED, HOWEVER, IF ATLANTA, GEORGIA IS NOT CONVENIENT FOR THE HEARING, THE PARTIES MAY MUTUALLY AGREE ON AN ALTERNATIVE LOCATION. THE FEDERAL OR STATE LAW THAT APPLIES TO THESE OFFICIAL RULES WILL ALSO APPLY DURING THE ARBITRATION. DISPUTES WILL BE ARBITRATED ONLY ON AN INDIVIDUAL BASIS AND WILL NOT BE CONSOLIDATED WITH ANY OTHER PROCEEDINGS THAT INVOLVE ANY CLAIMS OR CONTROVERSY OF ANOTHER PARTY, INCLUDING ANY CLASS ACTIONS; PROVIDED, HOWEVER, IF FOR ANY REASON ANY COURT OR ARBITRATOR HOLDS THAT THIS RESTRICTION IS UNCONSCIONABLE OR UNENFORCEABLE, THEN THE AGREEMENT TO ARBITRATE DOESN’T APPLY AND THE DISPUTE MUST BE BROUGHT IN A COURT OF COMPETENT JURISDICTION IN FULTON COUNTY, GEORGIA.
