California Privacy Notice

This California Consumer Privacy Policy and Notice at Collection (the “California Privacy Notice” or “Notice”) is provided pursuant to the California Consumer Privacy Act, as amended by the California Privacy Rights Act of 2020 (the “CCPA”) and other relevant laws and rules in force in the State of California.  

This California Privacy Notice is provided by Rain Technologies Inc. (“Rain”) on behalf of Rain and each of its Affiliates (the “Company” or “we” or “us”).  For the purposes of this Notice, the term “Affiliate” means any entity that is “controlled” by Rain or that operates under “common branding” with Rain, as each of those terms (i.e., “controlled” and “common branding” is defined by the CCPA).

This California Privacy Notice applies solely to the treatment by the Company of “Personal Information,” as defined below, relating to an individual who resides in the State of California.  This California Privacy Notice supplements the Rain Privacy Notice.  If you are a consumer who holds an account with Rain and resides in California, please carefully review both this Notice and the Rain Privacy Notice.

PLEASE CAREFULLY READ THE TERMS AND CONDITIONS THAT APPLY TO YOUR RAIN ACCOUNT OR TO YOUR USE OF RAIN’S SERVICES.  PLEASE KEEP A COPY OF THIS CALIFORNIA PRIVACY NOTICE FOR YOUR RECORDS.

For an individual California resident who is covered by the CCPA, (“you” or “your”), this California Privacy Notice explains how Rain collects, uses, and discloses your Personal Information. This Notice constitutes our Notice at Collection to you and our Privacy Policy, pursuant to the CCPA.

I. Background

Subject to certain conditions and exceptions, the CCPA applies to “Personal Information” about an individual who is a resident of California.  In general, the term “Personal Information” under the CCPA means information that identifies, relates to, or could reasonably be linked directly or indirectly with a particular California resident, and includes certain categories of Personal Information discussed below that constitute “Sensitive Personal Information.”  Separately, data that constitutes “Nonpublic Personal Information” under the Consumer Financial Protection Bureau’s Regulation P (12 C.F.R. part 1016) is regulated under federal law (Title V of the Gramm-Leach-Bliley Act).  

Even though Rain provides different privacy notices to comply with distinct requirements under applicable law, Rain’s commitment to privacy and data security is constant: Consistent with Rain’s obligations under applicable laws and regulations, Rain has implemented an information security program designed to protect Personal Information and Nonpublic Personal Information against unauthorized disclosures or access, as well as unlawful or unauthorized alteration, destruction, or loss.

II. Collection, Use, Retention, and Disclosure of Personal Information

We may collect, use, and disclose your Personal Information as described in this Notice.

We collect Personal Information in a variety of contexts. For example, we collect Personal Information to provide financial products and services, including when we act as a service provider to a bank that provides to you a banking product or service, such as the Rain Debit Card.  The Company also collects Personal Information relating to an individual California resident who seeks employment with, or is a current or former employee of, the Company.

The Personal Information that we collect about a specific California resident will depend on, for example, our relationship or interaction with that individual resident.

A. In the preceding 12 months, we have collected the following categories of Personal Information:

1. Personal Identifiers—such as your real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, Social Security number, driver’s license number, passport number, or similar identifier(s);
2. Customer Records Information—Your contact information (e.g., mobile telephone number, residential address, and email address);
3. Financial Account or Payment Card Details—The account number for any payment card, deposit account, or similar financial account that you use with your Rain Account or which you link to any account that Rain services;
4. Commercial Information—Information about one or more of your transactions at a point-of-sale, including via an online transaction, for a purchase of goods or services;
5. Geolocation Data—Geolocation data, such as the location of the smartphone or similar device that you use;
6. Internet or Other Electronic Network Activity Information—Browsing history, search history, and information regarding your interaction with our websites, the Rain App, or our advertisements;
7. Professional or Employment-Related Information—Professional or employment-related information, such as work history, timekeeping data, wage rate(s) or other earnings data, and, in connection with your application to the Company for employment or your current or former employment by the Company, data contained in your application, payroll and benefit information, leave and absence information, and performance information or disciplinary information;
8. Inferences—Inferences that we may draw based on the Personal Information described above to create a summary about you, such as your individual preferences or characteristics.

We do not sell any of the categories of Personal Information listed above, in this Section II(A).

We share only the categories of Personal Information identified in Section III, entitled “Notice of Right to Opt-out of Sale/Sharing,” and only for the purpose described in that section.

B. Categories of Sources

We collect the categories of Personal Information described above from the following categories of sources:

1. Directly from you, such as when you create or use a Rain Account, use the Rain App or our website, complete a form, or contact our customer support;
2. Identity verification and fraud prevention service providers;
3. Automatically from your device or browser, including through cookies, software development kits, and similar technologies; and
4. Advertising networks and data analytics providers.

C. Purposes for Collecting Personal Information

We collect and use the categories of Personal Information described above for the following business and commercial purposes:

1. Providing, servicing, and supporting our products and services, including earned wage access, the Rain App, and, when we act as a service provider to an insured depository institution or another financial institution;
2. Verifying your identity or your eligibility for one or more products or services, and detecting and preventing fraud, monitoring activity for potential security incidents, and guarding against other unlawful activity;
3. Communicating with you about your Rain Account and responding to your inquiries and requests;
4. Complying with applicable laws, regulations, and legal process, and enforcing our terms and agreements;
5. Maintaining and improving the safety, security, and performance of our services, as well as developing new products or new features;
6. Marketing and advertising our products and services, including as described under Section III, entitled “Notice of Right to Opt-out of Sale/Sharing,” below; and
7. With respect to job applicants and current and former employees, recruiting, hiring, and administering employment, payroll, and benefits, and complying with employment-related legal obligations.

D. Disclosures of Personal Information for a Business Purpose

In the preceding 12 months, we have disclosed each of the categories of Personal Information described above to service providers and contractors that process Personal Information on our behalf for the business purposes described above. The categories of recipients include:

1. Bank partners, payment processors, and card networks, and other financial institutions;
2. Service providers that assist us or our bank partners with identity-verification services or fraud-prevention products and services;
3. Cloud hosting, data storage, information technology, and security providers;
4. Customer support and communications providers;
5. Data analytics providers; and
6. Professional advisors, such as auditors, accountants, and attorneys.

We may also disclose Personal Information to government authorities, courts, or other parties when required or permitted by law, including to comply with legal process, to protect our rights or property, or to detect and prevent fraud or other unauthorized or unlawful activity.

E. Sensitive Personal Information

In addition to the Personal Information described above, we may collect the following categories that are defined as “Sensitive Personal Information under the CCPA:

1. Personal information that reveals your Social Security number, driver’s license number, or state identification card number;
2. Your account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing you to access to an account via the Rain mobile application;
3. Personal information that reveals your precise geolocation; and
4. Personal information that reveals the contents of your mail, email, and text messages where Rain is not the intended recipient of the communication.

We collect and use Sensitive Personal Information only for the purposes described above, including to verify your identity, to detect and prevent fraud, unauthorized activity, and other unlawful activity, to provide and secure our products and services, and to comply with our legal obligations. We do not sell or share Sensitive Personal Information.

F. Retention

We maintain the categories of Personal Information and Sensitive Personal Information described above for as long as is necessary for the purposes described in this California Privacy Notice or otherwise authorized by law. Our right to retain Personal Information generally means that we are permitted to hold the Personal Information for as long as one of the following apply:

1. Your Personal Information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the information;
2. Your Personal Information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which we collected the Personal Information;
3. Your Personal Information is reasonably required to protect or defend our rights or property, which will generally relate to applicable laws that limit actions in a particular case; or
4. We are otherwise required or permitted by applicable laws or regulations to keep your Personal Information.

If Personal Information is used for more than one purpose, we will retain it until the purpose with the latest period expires. For more information about our retention policies, please contact us using the contact details listed below in Section VI of this Notice.

III. Notice of Right to Opt-out of Sale/Sharing

Rain does not sell your Personal Information.  However, in some circumstances, Rain may “share” to third parties Personal Information collected from our website for the purposes of “Cross-contextual Behavioral Advertising,” as each of those terms is defined in the CCPA.

The following contains the categories of Personal Information about a California resident that we may have shared with third parties for Cross-contextual Behavioral Advertising, as covered by this Notice:

1. A consumer’s browsing history, search history, interactions with a website application or advertisement(s), or similar tendencies on our websites;
2. Professional or employment-related information; and
3. Inferences drawn from any of the Personal Information listed above which may reflect a consumer’s preference or interests.

Categories of third parties with whom we may share your information for the purposes of Cross-contextual Behavioral Advertising:

1. Certain third parties, such as websites and advertisers, which may contract with us for Cross-contextual Behavioral Advertising purpose, and
2. Data aggregation services.

Other commercial purposes for sharing your information:

• Delivering personalized advertising and marketing, including on websites maintained by non-affiliated persons or the websites or mobile application of a non-affiliated entity.  

We do not have actual knowledge that we sell or share the Personal Information of consumers under 16 years of age.

IV. How to Opt-Out of Our Sharing of Your Personal Information

You can request to opt out from the sharing of your Personal Information for Cross-contextual Behavioral Advertising.  Rain offers the following methods for opting out:

1. Click “Your Privacy Choices” link at the bottom of our website. On the pop-up window, select the tab marked “Sharing and Selling of Personal Data.”

Here you will be able to choose your preferences.   Note: you can make changes to your preferences at any time; when you make a new change, your new change will override your previous setting(s).

Opt-Out Preference Signals. If your browser or device sends an opt-out preference signal, such as the Global Privacy Control, that meets the requirements of the CCPA, we will treat that signal as a valid request to opt-out of sharing for that browser or device and any consumer profile associated with it. If you are logged in to your Rain Account when we receive the signal, we will also apply it to your Rain Account. The signal does not apply to other browsers or devices you use unless you are logged in to your Rain Account. You can enable an opt-out preference signal through the settings of a browser or browser extension that supports it.

V. California Consumer Rights

A. In General.

Subject to certain exceptions, as a resident of California, you may have the following three “California Consumer Rights” relating to our treatment of your Personal Information:

Right to Access:   You have the right to request access to:

1. Categories of Personal Information we have collected about you, including the:

i. Categories of sources from which your Personal Information has been collected or obtained;

ii. Business or commercial purposes for which we collected or disclosed Personal Information;

iii. Categories of recipients to which we disclosed Personal Information; and

iv. Categories of Personal Information that we disclosed for a business purpose, and for each category identified, the categories of recipients to which we disclosed that particular category of Personal Information; or

2. The specific elements of Personal Information we have collected about you.

Right to Deletion: Subject to certain limitations, you may request deletion of your Personal Information.

Right to Correction: You have the right to request that we correct Personal Information we maintain about you, but which you believe is inaccurate.

B. Non-Discrimination Statement

You have the right to be free from unlawful discrimination for exercising your rights under the CCPA. We will not discriminate against you based upon your exercising your rights with respect to your personal information. If you are a job applicant or a current or former employee or independent contractor of the Company, we will not retaliate against you for exercising your rights under the CCPA.

C. Exercising Your California Consumer Rights

If you reside in California and wish to exercise any of your California Consumer Rights, you may take one or both of the following steps:

2. Complete an Online California Personal Information Request Form.

If you submit an Online California Personal Information Request Form, you must include your first and last name, email address, residential address, and postal zip code. You may be asked to provide additional proof of identification so that we can verify your identity, and we may require that you validate your request. We verify your identity by matching the information you provide with the information we maintain about you. Depending on the sensitivity of the Personal Information involved and the nature of your request, we may ask you to provide additional information or to confirm the request through the email address or mobile telephone number associated with your Rain Account.

Please note that you may submit a request to exercise your “Right to Access” your Personal Information not more than twice in any 12-month period.

D. Right to Limit Use and Disclosure of Sensitive Personal information:

We do not use or disclose Sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the CCPA.

E. Authorized Agents

You have the right to designate an authorized agent to act on your behalf to exercise your rights under the CCPA. To do so, Rain must verify your identity, and your authorized agent must have written permission from you. We reserve the right to deny a request from an agent that does not submit adequate proof that they are authorized to act on your behalf.

VII. Changes to This California Consumer Privacy Act Notice

Rain must change, or must post an updated version of, this Notice from time to time, and at least once per year.  When Rain does change, or post an updated version of, this Notice, Rain will post the revised Notice on this page with a new “Last Updated” date.
