Cover Me AI Assistant Terms And Conditions

Effective Date: June 25, 2026

These Terms and Conditions (“Terms”) apply to the “Cover Me AI Assistant” feature offered on the Rain App.

IMPORTANT:  These Terms apply to You when You enable, as well as each time You use, the Cover Me AI Assistant. If Rain makes one or more changes to these Terms that materially affect how You may use the Cover Me AI Assistant Rain will provide a notice to You that describes the change(s) to these Terms or the Cover Me AI Assistant, as applicable. If You decide, for any reason, to reject these Terms, You must disable the Cover Me AI Assistant in the Rain App and stop using the Cover Me AI Assistant.

Each time You use the Cover Me AI Assistant, please review the “Effective Date” of these Terms. So long as You keep the Cover Me AI Assistant enabled in Your Rain Account, You are accepting these Terms.

IMPORTANT INFORMATION WILL BE PROVIDED TO YOU IN ELECTRONIC RECORDS, SUCH AS VIA EMAIL.

As stated in the EWA Agreement, the use of the Rain App or any part of the Services with Your mobile phone, tablet, or laptop represents Your agreement, as well as Your course of dealing, to conduct transactions and communicate with Rain via electronic methods.

1. General Terms

The person who downloads or uses the Rain App or uses Rain’s Site (“You”) and who chooses to use the Cover Me AI Assistant agrees to the then-current version of: (i) these Terms; (ii) the EWA Agreement; and (iii) the Terms of Service that apply to the use of the Rain App or Rain’s Site.

Rain may, at any time, change any condition, term, or provision of these Terms for the Cover Me AI Assistant, except to the extent not permitted by applicable law. This means that Rain may change: (i) these Terms in ways that may affect how You can use the Cover Me AI Assistant, such as by adding new conditions; and (ii) the type or amount of any fee that may be imposed for participating in the Cover Me AI Assistant or conducting transactions using the Cover Me AI Assistant.

Capitalized words that are not defined specifically for use in these Terms have the meanings assigned to them in the EWA Agreement or the Terms of Service that apply to the use of the Rain App or Rain’s Site, as applicable. For example, the term “Bank” means the insured depository institution that You choose for Your transaction account(s), such as a checking or savings account, and “Primary Linked Account” means the specific transaction account at Your Bank that You select to be linked to Your Rain Account.

For the purposes of these Terms, the term “business day” means any day, other than Saturday, Sunday, or a U.S. federal holiday.

You may choose whether, and when, to use the Cover Me AI Assistant. Use of the Rain App for other Services is not subject to the condition of using the Cover Me AI Assistant. You may disable the Cover Me AI Assistant at any time in accordance with Section VII of these Terms.

2. Description of the Cover Me AI Assistant

The Cover Me AI Assistant is an AI-powered feature within the Rain App that monitors Your linked external bank account(s) and analyzes Your transaction history to generate estimates of Your projected account balance. The Cover Me AI Assistant runs periodically to compare Your projected account balance against estimated upcoming expenses; when its estimate of Your projected balance might run low before Your next payday, the Cover Me AI Assistant may suggest a transfer. Based on these estimates, the Cover Me AI Assistant may make one or more “suggestions” to You.  For example, the Cover Me AI Assistant may “suggest” that You transfer funds from Your available earned wages (i.e., by requesting an Earned Wage Payment via Rain’s Earned Wage Access services) to help maintain liquidity in Your linked account before Your next payday.

To use the Cover Me AI Assistant, You must: (i) link at least one external bank account via Plaid or another third-party data aggregation service approved by Rain; and (ii) link a debit card associated with the account You wish to protect, to enable fund transfers. You may change Your Primary Bank Account, except to the extent that Rain prevents or postpones the change (e.g., to delay the change in order to complete a pending Electronic Payment). As between You and Rain, You agree that Rain shall not be responsible for any act or omission made by Your Bank in connection with Your request of or Rain’s action relating to an Electronic Payment, including any EWA transfer made when You use the Cover Me AI Assistant.

If you change the debit card to one NOT associated to Your linked account, the Cover Me AI Assistant will be unable to perform as intended. You must ensure that you link a debit card associated with the bank account you wish for the Cover Me AI Assistant to monitor.

Your Agreement with Plaid:  Plaid, Inc. acts as a service provider to Rain in connection with the Services, including to support certain features of the Cover Me AI Assistant.  For example, Plaid provides to Rain the data about the transactions in Your Primary Bank Account. The Cover Me AI Assistant requires You to enable the feature in Your Rain Account and, in doing so, You must agree to certain terms and conditions established by Plaid. Plaid’s terms and conditions are presented to You at the time You enable the Cover Me AI Assistant. If You decline to agree to Plaid’s terms and conditions, You must disable the Cover Me AI Assistant and cease using it.

3. Important Limitations

You acknowledge and agree that:

a. AI-Generated Estimates

The Cover Me AI Assistant’s projections, estimates, and suggested transfer amounts are generated by artificial intelligence using automated analysis of Your transaction history and other available data. All of the Cover Me AI Assistant’s projections are only estimates.  The Cover Me AI Assistant’s projections may not accurately reflect Your actual account balance, upcoming transactions, or financial circumstances.

b. Not Professional Financial Advice

Cover Me AI Assistant suggestions are only AI-generated estimates based on Your available transaction history.  This means that the Cover Me AI Assistant does not provide or enable any recommendation from a financial advisor. You should not rely on Cover Me AI Assistant suggestions as a substitute for financial guidance from a professional or from one or more human (i.e., non-AI generated) sources who otherwise could provide that financial guidance to you.

c. No Guarantee Against Fees Charged to Your Primary Bank Account

No Guarantee Against Charges Imposed by Your Bank:  Rain does not guarantee that use of the Cover Me AI Assistant will prevent overdraft fees, non-sufficient funds (NSF) fees, maintenance fees, or any other charges from Your financial institution(s).

You Must Continue to Monitor Your Primary Bank Account:  The Cover Me AI Assistant does not relieve You from the responsibility of managing transactions to Your Primary Bank Account.  Without limiting the scope of the preceding sentence, only You (and not Rain via the Cover Me AI Assistant) are responsible for  tracking deposits, withdrawals, charges (or credits), and monitoring other aspects of Your Primary Bank Account. You are solely responsible for monitoring Your account balance(s) and managing Your finances.

d. Third-Party Data

The Cover Me AI Assistant relies on data from third-party sources, including Plaid and Your financial institution(s). This data may be incomplete, delayed, or inaccurate. Rain is not responsible for errors, omissions, or delays in data provided by third parties. If Plaid does not return any data about Your Primary Bank Account, or the data that Plaid returns reveals an error code, Rain treats that event as an incomplete data retrieval, and the Cover Me AI Assistant will not generate any suggestion for that session.

e. Employer-Set Limits

Any EWA transfer that You authorize following a Cover Me AI Assistant suggestion remains subject to any limits or restrictions that Your employer establishes for Your Rain Account. For example, if Your employer restricts Your use of the Rain Account to not more than two (2) EWA transfers per pay period, Rain will not process an EWA transfer via the Cover Me AI Assistant if You have already obtained two (2) EWA transfers in that same pay period. You acknowledge that Rain has no control over limits imposed by Your employer.

4. User Control — No Obligation to Act

You retain full control over any action suggested by the Cover Me AI Assistant. You are never obligated to act on any suggestion. The Cover Me AI Assistant does not initiate any transfer, withdrawal, or other transaction in Your Rain Account or in Your Primary Bank Account.  Only You have the authority and control over decisions regarding transactions in Your Rain Account or in Your Primary Bank Account.  So long as You keep the Cover Me AI Assistant enabled in Your Rain Account, You are permitting Rain to generate suggestions for You.  However, no EWA transfer will be made without affirmative authorization and action taken by You.

Each suggestion requires You to: (i) review the proposed action and suggested amount; and (ii) affirmatively authorize any fund transfer by tapping “Cash Out,” or a similar confirmation, within the Rain App. You may decline any suggestion at any time simply by taking no action. Declining a suggestion will have no effect on Your access to the Cover Me AI Assistant or any other Rain Services.

IMPORTANT:  Even if You authorize a transfer following a Cover Me AI Assistant suggestion, that transfer will not be completed if any of the following conditions apply:

(i)    Insufficient EWA Balance:  You must have at least the minimum amount of available EWA balance in Your Rain Account to complete a transfer. Rain may set a minimum transfer amount from time to time.

(ii)   Employer Limits:  The transfer does not conform to any limit Your employer has established for Your Rain Account, as described in Section III.5.

(iii)  Incomplete Data:  Plaid data for Your Primary Bank Account is unavailable or returns an error code at the time of the suggestion, as described in Section III.4.

On-Demand EWA Requests While Cover Me AI Assistant Is Enabled:  If You use the Cover Me AI Assistant, You still are permitted to use the Rain App for making on-demand requests for one or more Earned Wage Payments. You acknowledge and agree that any on-demand Earned Wage Payment that You obtain will reduce the balance of Your earned Wages in Your Rain Account. If Your available EWA balance falls below the amount needed for You to act in response to a suggestion from the Cover Me AI Assistant, the transfer will not be completed. If You need or wish to make an on-demand request for an Earned Wage Payment, You agree that You first shall check the balance of Your earned Wages.

5. Data Collection and Use

To provide the Cover MeAssistant, Rain collects and processes data from Your linked external bank account(s) via Plaid or other approved third-party data aggregation services. This data may include: (i) account balance(s), including current and available balances; (ii) transaction history, including deposits, withdrawals, and purchases; (iii) pending transactions; and (iv) recurring payments and deposit patterns.

By enabling the Cover Me AI Assistant, You authorize Rain to access, collect, and use this data to generate estimates, projections, and suggestions on Your behalf. Rain may also use data relating to Your use of the Cover Me AI Assistant to improve the Cover Me AI Assistant and develop new features. Rain’s collection and use of Your data is subject to Rain’s Privacy Notice.

6. Fees

The Cover Me AI Assistant feature is included in your Rain One subscription. However, any Earned Wage Payment that You authorize after reviewing a Cover Me AI Assistant suggestion is subject to the same fees and terms as other Earned Wage Payments that You obtain when You request an expedited transaction (i.e., not the option for $0.00).  The applicable fee (if any) will be clearly displayed before You authorize any transaction.

Rain may, from time to time, change the amount of any fee that may be imposed for transactions involving an expedited Earned Wage Payment conducted in connection with the Cover Me AI Assistant. The amount of each applicable fee will be presented to You in the Rain App prior to the charge to Your Rain Account. This means that Rain may change: (i) these Terms in ways that may affect how You can use the Cover Me AI Assistant, such as by adding new conditions; and (ii) the type or amount of any fee that may apply to transactions initiated through the Cover Me AI Assistant.

Rain shall not be obligated to make any refund(s) of fees once paid, except to the extent required by applicable law.

7. Disabling the Cover Me AI Assistant

You may disable the Cover Me AI Assistant at any time through the Rain App by navigating to Agent Settings (icon to the left of the message bar on the Heart tab)  > Rain AI Assistants > Cover Me. Rain does not impose a fee for disabling the Cover Me AI Assistant. You may disable the Cover Me AI Assistant at any time on any day (i.e., not solely on a business day). Disabling the Cover Me AI Assistant will stop all monitoring, projections, and suggestions associated with this feature but will not affect Your access to other Rain Services.

If You disable the Cover Me AI Assistant and then later decide to again use the Cover Me AI Assistant, You will be subject to the then-current version of these Terms (which also may be subject to change in accordance with Section I).

8. Disclaimer of Warranties

THE COVER ME AI ASSISTANT IS PROVIDED “AS IS” AND “AS AVAILABLE.”  RAIN MAKES NO WARRANTY OR REPRESENTATION, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, RELIABILITY, TIMELINESS, OR COMPLETENESS OF ANY PROJECTION, ESTIMATE, OR SUGGESTION GENERATED BY THE COVER ME AI ASSISTANT. RAIN DOES NOT WARRANT THAT USE OF THE COVER ME AI ASSISTANT WILL ACHIEVE ANY PARTICULAR RESULT, INCLUDING THE AVOIDANCE OF OVERDRAFT FEES, NSF FEES, OR OTHER BANK CHARGES. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RAIN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RAIN SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE COVER ME AI ASSISTANT, INCLUDING ANY DAMAGES RESULTING FROM: (a) OVERDRAFT FEES, NSF FEES, MAINTENANCE FEES, OR OTHER CHARGES INCURRED AT YOUR FINANCIAL INSTITUTION(S); (b) INACCURATE, INCOMPLETE, OR DELAYED DATA FROM PLAID, YOUR FINANCIAL INSTITUTION(S), OR OTHER THIRD PARTIES; (c) ANY PROJECTION, ESTIMATE, OR SUGGESTION THAT DOES NOT ACCURATELY REFLECT YOUR FINANCIAL CIRCUMSTANCES; OR (d) YOUR DECISION TO ACT OR NOT ACT ON ANY COVER ME AI ASSISTANT SUGGESTION.

THE FOREGOING LIMITATIONS APPLY EVEN IF RAIN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL RAIN’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE COVER ME AI ASSISTANT EXCEED FIFTY DOLLARS (US $50.00).

10. Arbitration Agreement; Other Terms

a. BINDING ARBITRATION

ARBITRATION NOTICE:  THE EWA AGREEMENT CONTAINS AN ARBITRATION CLAUSE. EXCEPT FOR CERTAIN TYPES OF DISPUTES MENTIONED IN THE ARBITRATION CLAUSE, YOU AND RAIN AGREE THAT DISPUTES BETWEEN US REGARDING THE COVER ME AI ASSISTANT WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION, AND YOU AND RAIN WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

b. Discontinuing the Services

Rain reserves the right to modify or discontinue the Services (or any portion of the Services), including the Cover Me AI Assistant, temporarily or permanently. Rain shall notify You in advance of Rain’s election to exercise its right to discontinue the Services. Rain shall not be liable to You or any third party in the event that Rain exercises its right to modify or discontinue any portion or all of the Services.

c. Term

The term for the Cover Me AI Assistant begins on the date on which You enable the Cover Me AI Assistant and accordingly accept these Terms, and continues until terminated. Rain and You agree that the term runs until (i) You disable the Cover Me AI Assistant or (ii) Rain cancels Your participation in, or discontinues, the Cover Me AIAssistant, whichever is earlier.

d. Modifications to These Terms

Rain may modify these Terms at any time by posting updated terms in the Rain App or notifying You via email. Your continued use of the Cover Me AI Assistant after such modifications constitutes Your acceptance of the updated Terms.
